The plugin is built to keep you careful by default, but it gives no legal advice, and no regulator has approved it. Please ask a lawyer where you sell.
United States. Some state insurance regulators have warned that paid package protection can count as unlicensed insurance, and that a guarantee label does not by itself change that, above all for theft after delivery. Free mode is a normal seller promise and carries much less of this risk.
EU and UK. The seller already carries the transit risk until the customer has the goods, so a fee for transit loss can sell a right the buyer already has. Extra payments need express consent, so a pre-ticked box is not allowed. Use free mode for these countries, or leave them out of the country list.
Pre-ticked boxes. Several retailers and one large protection provider face proposed class actions over pre-selected fees. The plugin has no way to pre-tick the box, not in settings, tests or filters.
What the plugin does about it:
- It starts Off. Nothing shows to shoppers until you choose a mode.
- Stolen after delivery is off by default, with a warning.
- The disclosure says the guarantee is optional, offered by the store and not insurance. Saving warns you about words that sound like insurance.
- The compliance checklist on the General section shows where you stand.
- Every email to a customer says statutory rights are not affected.
